These terms and conditions outline the rules and regulations for the use of FT-Düsseldorf's Website, located at https://ft-duesseldorf.de
By accessing this website we assume you accept the Terms and Conditions. Please do not continue to use FT-Düsseldorf if you do not agree to take all of the terms and conditions stated on this page.
1. Scope:
These terms and conditions govern all legal relationships between FT-Düsseldorf and its customers. They replace all previous terms and conditions and apply exclusively to these customers. Other terms and conditions are expressly rejected.
2. Conclusion of contract
The contract is only concluded when FT-Düsseldorf sends a confirmation email. There is no obligation to conclude the contract under any circumstances.
3. Booking requests
FT-Düsseldorf only accepts booking requests via its website, and the requestor must correctly state the full name, number of passengers and number, size, weight and type of luggage when making the request. FT-Düsseldorf reserves the right to reject booking requests due to the number of passengers or the size, weight or type of luggage.
4. Reasons for termination by FT-Düsseldorf
FT-Düsseldorf is entitled to cancel the order even after confirmation if the number of passengers and/or the number, size, weight or type of luggage is significantly higher than agreed.
This right of termination also applies if child seats are required for some of the passengers but the customer did not inform the customer of this when making the booking request.
FT-Düsseldorf is also entitled to cancel the order after confirmation if the passenger and/or their luggage are not fully present at the pick-up location more than 15 minutes after the agreed time.
For airport pick-ups, FT-Düsseldorf is entitled to terminate the contract after 60 minutes of waiting in vain. Flight delays do not affect the right to terminate the contract.
FT-Düsseldorf is also entitled to cancel the order after confirmation if the passengers and/or luggage pose a danger to the driver, vehicle, traffic or third parties. This right of cancellation applies in particular in the case of contagious diseases, drunkenness, drug use, harmful/aggressive behavior towards others and serious insults of any kind.
In the case of such terminations due to circumstances that are the passenger's responsibility, FT-Düsseldorf is entitled to charge the agreed fee as compensation. The customer is entitled to prove that the damage is less, in which case this lesser damage will be charged.
These terminations can be made at any time, including immediately before the start of the journey, and terminations due to contagious diseases, drunkenness, drug use, harmful/aggressive behaviour towards others, as well as serious insults of any kind can also be made during the journey.
5. Cancellation by the customer / costs
The customer can only cancel time bookings (hourly rental) up to 4 hours before pick-up. For one-way transfers, 4 hours before pick-up. If the cancellation occurs later, the full agreed fee must be paid as compensation. The customer is entitled to prove that the damage was less.
6. Customer and passenger obligations
Customers and passengers are obliged to follow the driver's instructions during the journey and to refrain from any behavior that compromises the safety of the driver, the vehicle or road traffic or the cleanliness of the vehicle. Customers and passengers are also obliged to provide the driver with truthful information about the contents of their luggage so that the driver can assess whether this poses a danger to them, the vehicle or road traffic.
Customers are obliged to arrange pick-up times taking into account the usual traffic conditions so that the destination can be reached without risks for the driver, the vehicle or road traffic and without speeding. In particular, they must plan for unexpected traffic jams.
7. Payment
Payment is made via Paypal, cash, credit card or, for verified customers, by invoice. Payments are only accepted in euros.
8. Routes / Surcharges for route deviations, stopovers and delays of the customer
FT-Düsseldorf will take the fastest route depending on traffic conditions.
For an additional charge, stopovers and route deviations can also be agreed after booking confirmation. FT-Düsseldorf is not obliged to enter into these additional agreements and can refuse them without giving reasons.
If FT-Düsseldorf does not exercise its right of termination due to delay, it is entitled to charge a delay surcharge of €15 for each quarter of an hour or part thereof after the expiry of the above-mentioned waiting periods.
9. Limitation of Liability / No Liability for Traffic Situation
FT-Düsseldorf is liable for slight negligence in the case of violation of essential contractual obligations, as well as in the case of intent, gross negligence and damage to body, life and health. Otherwise, liability is excluded.
Statutory warranty rights for defects remain unaffected, so the customer has the right to withdraw from the contract, to repair/re-delivery and to reduce the price if corresponding defects exist, even in the event of exclusion of liability.
In the case of negligently caused material and financial damage, FT-Düsseldorf is only liable if a material contractual obligation is breached, but the amount is limited to the damage that was foreseeable and typical for the contract at the time the contract was concluded. Material contractual obligations are those whose fulfillment characterizes the contract and on which the provider and customer can rely.
To the extent that items are left to the customer, the right to compensation for damages under product liability law remains unaffected by the exclusion of liability.
FT-Düsseldorf is not liable for delays due to traffic conditions.
10. Applicable law / place of jurisdiction
The law of the Federal Republic of Germany applies. If the customer is a consumer residing in another EU country, mandatory consumer protection regulations and mandatory consumer protection case law of the consumer's country of residence remain applicable. UN Convention on Contracts for the International Sale of Goods is excluded. The courts at the registered office of FT-Düsseldorf have local jurisdiction for contracts with merchants. The contract language is German.
